M Breaux IP Law was founded to help businesses and individuals protect their creative and business intellectual property. With practical insight and deep roots in the profession, Marie helps clients with trademark and copyright registrations, licenses, as well as federal court litigation and proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. 

Marie handles the most complex IP matters, from takedown programs against bootleg goods or services to the thorny issues that arise when important, but competing, principles clash. She excels in the grey areas of IP law: untangling the web of First Amendment, parody, satire, fair use, cultural respect and preservation, and the hard work of incorporating older works into new creations. She has a special interest in the preservation of works held by archives and other cultural institutions and in finding solutions to make those assets available for use.

IP Law Experience

Marie Breaux advises clients on trademark clearances and registrations across highly competitive industries, including food and beverage, education, entertainment, software, and apparel. She is known for her skills in managing high-stakes rebranding projects where clients only have one chance to make the new brand name stick. Her work before the Trademark Trial and Appeal Board includes successful oppositions, cancellations, and summary judgment motions resulting in favorable outcomes.

Marie also has extensive copyright experience. She has registered and manages substantial copyright portfolios. She also handles complex clearance issues, licensing, and publication agreements on both the creator and publisher sides.

Her litigation and mediation experience includes favorable rulings at the Fifth Circuit Court of Appeals in both copyright and trademark matters, as well as effective resolution of infringement cases through settlement and strategic motion practice.

Admissions

Marie is admitted to practice before the Supreme Court, the Louisiana Supreme Court, various federal district courts, and the U.S. Fifth Circuit Court of Appeals.

Professional Contributions

Marie is a member of the IP Section of the American and Louisiana State Bar Associations. To share her wealth of knowledge, she is a frequent speaker at business, entrepreneurship, and legal seminars. Previously, Marie served as chair of both the Intellectual Property Law and Antitrust and Trade Regulation Sections of the Louisiana State Bar.

Languages

Marie speaks French fluently and has basic language skills in Spanish. One day, she would like to add Italian to the line-up.

Education

Marie received her J.D. magna cum laude in 1985 from Tulane Law School, where she earned Order of the Coif and where she previously served as an adjunct lecturer in copyright and trademark practice. She earned her undergraduate degree with honors from the University of Chicago in 1982, where she was made a member of Phi Beta Kappa.

Past Professional Experience

Before founding M Breaux IP Law, Marie was special counsel at Milling Benson Woodward, LLP for five years. During this time, she managed a large portfolio of trademarks and worked on projects ranging from the latest forms of software licensing to the use of centuries-old archival materials. Marie also had a partnership at Liskow & Lewis (now Liskow), where she handled intellectual property matters, commercial litigation, and antitrust counseling. Her career in law began with a rewarding two-year clerkship with the Hon. Tom Stagg, Chief Judge of the United States District Court for the Western District of Louisiana.
